Legislation Introduced in the Senate to Make Gun Sellers Liable for Shootings

Malevolent action taken by the federal government is rarely overt. Any action taken by the government that is designed to strip away our rights is always marketed as being “for the good of the people.” That’s how they get away with it. The leaders of a republic cannot simply say “We’re taking these rights because they don’t belong to you anymore.” There must always be a drive that deceives the people into believing that the rights being taken away are not worth having.

After every mass-shooting, the Democrats trot out their dusty polemics, and attempt to gut our Second Amendment right to bear arms. Up until this point, their repeated attempts have failed to gain traction, despite their fear-mongering and usage of victims and families of victims as props. They haven’t gained traction because the evidence points in the opposite direction. In short, the American people aren’t buying what the Democrats are selling.

Given this, the left has begun to take different routes to strip our Second Amendment rights away. Enter Senator Tim Kaine (D-VA).

According to the Roanoke Times, Senator Kaine recently introduced a bill which would make gun sellers criminally liable if a firearm they sold was used criminally:

“The proposal would raise the bar for commercial and private dealers who are now protected from criminal prosecution unless they knew or had reasonable cause to believe that a customer had a criminal record, history of mental institutionalization or other disqualifying factor…

Kaine’s bill, the Responsible Transfer of Firearms Act, would make gun sellers criminally liable for a bad sale if they didn’t take reasonable, affirmative steps to determine the customer met federal criteria, according to a summary provided by Kaine’s office.”

In essence, Kaine wants to make gun sellers afraid to sell guns on the off chance they’ll be used in a crime. What determines “reasonable, affirmative steps” has yet to be delineated by Kaine, meaning these details will likely remain vague, keeping gun sellers in a state of uncertainty.

Many mass-shooters purchased firearms legally, passing background checks. Even Vester Lee Flanagan, the man who prompted the introduction of this bill, passed a background check. Clearly, other steps must be taken to make sure unstable individuals don’t obtain firearms, but it’s an unnecessary, and very deliberate attack on our Second Amendment rights to target gun sellers.

Placing invented and undefined liability on gun sellers will likely lead to restricted sales, or cause firearms businesses to close up shop altogether.

Because the left can’t get its way in the public sphere, they’re trying to make an end-run by intimidating gun sellers, choking our Second Amendment rights surreptitiously.

Luckily, this legislation has little chance of passing because Republicans control both the House and Senate, however, the intent is clear, the drive is there, and it will manifest at another time.

Under the pretense of “the good of the people”—that’s how tyranny begins. Tim Kaine, as well as those who support this type of legislation, regardless of their understanding of the larger picture, have continued the proud leftist tradition of strangling our freedoms.

As our freedom of religion, speech, assembly, et al. are further and further maligned, attacked, and restricted by the left, the inevitable result will be the death of our republic. Tim Kaine’s legislation is just one more step on that well-trod path.
