Hobby Lobby Wins! And so does Religious Freedom

By now you may have heard that the Supreme Court has decided in favor of Hobby Lobby in the Obamacare contraception mandate case.

This is a HUGE win for religious liberty and a big blow to Obamacare. The Court was divided 5-4 down pretty foreseeable lines. The Court’s conservatives sided with Hobby Lobby and the liberals came down against. The decision came down to Justice Kennedy who could swing either way… this time he chose religious freedom.

Justice Samuel Alito wrote the majority opinion (you can see it Here), and here is a little of what he had to say about the case.

The effect of the HHS-created accommodation on the women employed by Hobby Lobby and the other companies involved in these cases would be precisely zero. Under that accommodation, these women would still be entitled to all FDA-approved contraceptives without cost sharing.”

“Congress provided protection for people like the Hahns and Greens by employing a familiar legal fiction: It included corporations within RFRA’s definition of ‘persons.’ But it is important to keep in mind that the purpose of this fiction is to provide protection for human beings.”

Justice Kennedy added -

“Among the reasons the United States is so open, so tolerant, and so free is that no person may be restricted or demeaned by government in exercising his or her religion. Yet neither may that same exercise unduly restrict other persons, such as employees, in protecting their own interests, interests the law deems compelling. “

Sadly, while the case may be a win for freedom and American values, as Cal Thomas explains you shouldn’t expect liberals to b e happy about it.

    employers can now claim religious freedom from vaccines, blood transfusions or anything else they believe infringes on their religion! it will be interesting to see if this applies to minimum wage laws, child labor laws, civil right laws, EPA regulations, taxes, etc.

        Contraception is not free. You, me and every other citizen is paying for it through Obamacare. It should not be free. Don’t want to get pregnant? Then pay for your own contraceptives. They cost only about $9/mo at WalMart, Targets, etc. Contraception and abortion are not about women’s health; they are about women who want others to pay for their own mistakes. As I said………$9/month.

          Okie Dokie, Okie. You’re the one said I was FOS and accused me of attending NYU. I didn’t say squat about sharia law. My point was that private citizens have the right to run their businesses according to their beliefs. It’s a given they have to comply with our laws. But establishing a dress code or uniform for employees is not against any law I’m aware of, so if a muslim employer required its female employees to wear birkas, they are within their rights. Likewise if I wanted to forbid my employees from cross dressing, i’m within my rights too. People are free to quit their jobs if they don’t like the working conditions. That’s basically all I was saying. And if you’re more conservative than me, that’s pretty dang conservative.

    There has to be a defining moment in history the changed the Christian
    course of America. That defining point was in 1787 when the late 1700
    founders’ rejected the 1600 Christian Colonial governments of, by, and
    for God, based upon His immutable moral law (including Exodus 21:22-23,
    which, in principle, condemn infanticide) for a humanistic government
    of, by, and for the people, based upon fickle Enlightenment concepts.

        Ok here is the 800 pound gorilla in the room. First why do you keep spouting something that does not exist and never was in the Constitution in the first place? The Constitution was finally ratified in 1787, the very FIRST mention of the mythical Separation of church and state was in 1802 in a LETTER from Jefferson to his Baptist detractors. That means the very FIRST mention of this myth was 15 years AFTER the Constitution was ratified, meaning the ONLY way it could be in there is by a Constitutional Amendment, and according to the Library of Congress; that never happened. As such the decision by the Supreme Court on this issue is illegal and unconstitutional and cannot be enforced as they dont have the right nor constitutional authority to make a law out of thin air, Article 1 Section 1 of the Constitution FORBIDS THIS.

        And second, WHY when you want religion out of Government you claim Separation of Church and State, yet you never make the same claim when Government is trying to get into religion, its either both or neither.

        So maybe YOU need to butt out till you can understand American History.

    Not really a huge win of any type. A huge win would have been the courts mandating that employers only pay a wage in money – no insurance, no benefits of any type, just a decent wage and the employees can decide what they want on the free market.

If you are an insurance agent would you really charge more for a policy with birth control, a drug that is prescribed for many other uses as well, or would you rather sell a policy without birth control and pay for someone to deliver an unwanted baby? I am giving a discount for anyone eating the pill.

        Only if its a privately owned company. Do you realize this ruling is very narrow, only applies to large, closely-owned companies, about 40 in this country out of thousands. If Microsoft was taken over by a Muslim owner, they can’t enforce Sharia Law if they desired. Also, if you work for a company that VERY slightly enforces religious ideals, then don’t work there. Simple as that. Freedom of choice, right to work.

I was telling people way back in January that it was going to come out like this and now you have the talking heads saying this only applies to family owned businesses? Um NO IT DONT. If a family or a close group own more then 51% of the company and are religious, they CAN get the same exemption and that is what is scaring the crap out of the lefties as 90% of the jobs in todays economy are run by religious minded companies. Like Wal-Mart- Dominos-Chick Fil A-Interstate Batteries-Forever 21-Tyson Foods-Mary Kay-Timberland-Alaska Air-Marriott-JetBlue-Trijicon-ServiceMaster-George Foreman Grills and cooking supplies-H.E.B-Curves gyms-Tom’s of Maine-Hershey-Meijers-Sparten Stores-BMW-Lexus-Fiat-Pepsico-Heinz-Campbell Soups-Clear Channel just to name a few that have strict religious beliefs and have over 51% of the stock owned by family members or a group of Highly religious people. ALL of them qualify for the exemption under todays Supreme Court ruling. And if the lefties try and boycott all the companies that fit this ruling, they will be driving model T fords and have very little in their foreign made fridges.

    This is a MAJOR blow to Dumbama and the Democrats and that is why these lefties are losing their minds!

Mostly because some women can’t afford a $1000 IUD unless their employers are forced to pay for it. After all, these women are being forced to have sex against their will because their boyfriends won’t take no for an answer, so without free birth control the government is essentially raping them and forcing them to have babies, right?
